Residential Rental Property Maintenance Standards revocation under the Residential Tenancies Act, 2006

Summary of Proposal:
As noted in the 2012 Budget, the Ministry of Municipal Affairs and Housing will end the Province's enforcement role for property maintenance standards. As part of this change, the Ontario Regulation 517/06, which sets out these standards, will be revoked.

Most municipalities in Ontario have already passed by-laws that supersede existing provincial standards and so will be unaffected by this change. Of the approximately 164 municipalities with no or partial by-law coverage, only 49 have had any inspections within their boundaries in the last six years. This change is intended to achieve consistency across all municipalities.

Landlords will still be responsible for maintaining residential rental units in good condition and fit for habitation. Tenants will be able to apply to the Landlord and Tenant Board to resolve complaints.

The 2012 Budget committed that this change will occur by April 1, 2014 and while the exact date of the change remains to be confirmed, the anticipated date is January 1, 2014. Before this change occurs the Ministry of Municipal Affairs and Housing will encourage affected municipalities to assess their local need for a property standards by-law.
