Proposed amendments to Ontario Regulation 79/10 under the Long-Term Care Homes Act, 2007.

Summary of Proposal:
The Long-Term Care Homes Act, 2007 (LTCHA) and Ontario Regulation 79/10 (Regulation) are the main legislative authority for safeguarding resident rights, improving the quality of care, and improving the accountability of long-term care homes for the treatment, care, and well-being of over 78,000 residents.

The Ministry of Health and Long-Term Care is proposing a number of amendments to the Regulation. Firstly, to allow the Director under the LTCHA to designate reunification priority access beds for persons in crisis seeking to be reunified in a long-term care home with their spouses/partners. Separate waiting lists would be kept for these beds. Requirements to be placed on the waiting lists and priority for admission to these beds would be set out.

Secondly, the Minister or Director under the LTCHA would be required to disclose personal information about an individual to a health regulatory college and the Ontario College of Social Workers and Social Services Workers, where the Minister or Director is of the opinion that it is advisable to do so.

Thirdly, the Director under the LTCHA would be able to designate specialized units on his or her own initiative.

Fourthly, the Ministry would be permitted to serve a document by using a commercial courier.

The Ministry is proposing that the proposed amendments, if approved, would come into effect on January 1, 2018.
