In 2004 Ontario Regulation 97/04 was passed to introduce changes to the Conservation Authorities Act S. 28 regulations requiring the replacement of the previous S. 28 “Fill” regulations with the new S. 28 "Development, Interference with Wetlands and Alterations to Shorelines and Watercourses." All 36 conservation authorities have the new “Development” regulations in place.

On July 16, 2009, MNR submitted a request to the Ministry of the Environment (MOE) for an Exemption Regulation under subsection 39(f) of the EAA. The proposed regulation would exempt from the EAA Ontario's transfer of administration and control of Ipperwash Provincial Park to the Canada, for the use and benefit of the Chippewas of Kettle and Stony Point First Nation, rescinding the park boundaries, and pre-transfer activities.
