Home and Community Care Virtual Visits

Amendment to the definition of a "visit" and "hour of service" in section 1 of Ontario Regulation 386/99 of the Home Care and Community Services Act, 1994. The amendment aims to clarify that a visit and hour of service referred to in the Regulation may include virtual care using electronic means.
Effective Date:  January 1, 2020

Amendment to O. Reg. 950 under the Provincial Offences Act to create wording for the offence of interfering with highway fixtures.

The amendment creates wording for a new offence which sanctions any interference with highway fixtures such as traffic signs and other traffic control devices. The offence is found in Schedule 43 of the regulation.

New regulation made under the Connecting Care Act, 2019 (CCA) - Prescribed Organization

The regulation allows Ontario Telemedicine Network (OTN) to be prescribed for the purposes of subsection 40 (1) of the Connecting Care Act, 2019. Prescribing an organization in this fashion authorizes the detailed information gathering that is required to plan appropriately for potential transfers into Ontario Health (OH). The regulation was filed with the Registrar of Regulations on November 28, 2019 and will come into effect on January 1, 2020.

Amended regulation under the Child Care and Early Years Act, 2014

Ontario Regulation 137/15 under the Child Care and Early Years Act, 2014 was amended to ensure that camps would be allowed to operate for more than the current 13 weeks in a year in the event that there is a strike or lock-out that impacts instruction for students in publicly funded schools.

Proposed amendments to the Food Premises Regulation 493/17 under the Health Protection and Promotion Act

The following summary outlines two (2) proposed amendments to Ontario Regulation 493/17 (Food Premises) under the Health Protection and Promotion Act. The ministry is proposing an exemption to permit dogs in outdoor eating areas of food premises and under certain conditions, to allow dogs in areas of food premises where only pre-packaged and/or low risk food is displayed, served or sold to give Ontarians a choice to enjoy food as a social activity with their pet dogs.

Reducing Administrative Burden to Drug Manufacturers and Pharmacies

The Ministry of Health (MOH) is proposing amendments to the regulations under the Ontario Drug Benefit Act (ODBA) and Drug Interchangeability and Dispensing Fee Act (DIDFA), which if approved, reduce technical requirements, address discrepancies and misalignments with industry standards and polices in other provinces and territories (P/Ts) and modernize existing processes for Ontario pharmacies.

Proposed amendment to Regulation 552 (General) under the Health Insurance Act and the Schedule of Benefits for Laboratory Services under Reg. 552.

The Ministry of Health (Ministry) is proposing to: a) Amend Reg. 552 (General) under the Health Insurance Act; and b) Amend the Schedule of Benefits for Laboratory Services (SOB-LS) effective January 1, 2020. In the updated SOB-LS, the Ministry is proposing housekeeping and technical amendments.

Proposed changes to Ontario's Financial Protection Programs

As part of a broader effort to update and ensure the sustainability of the financial protection programs for the grains and livestock sectors, the Ontario Ministry of Agriculture, Food and Rural Affairs is seeking input on proposals for possible changes to the programs, which govern the buying and selling of beef cattle and grains and oilseeds in Ontario.

Regulation 461/96 (Court Proceedings For Automobile Accidents That Occur On Or After November 1, 1996) - Consequential Amendments to Vicarious Liability Limit.

Amendments to Various Regulations to Support the Medical Radiation and Imaging Technology Act

The Ministry of Health is proposing regulation amendments to O. Reg. 107/96 (Controlled Acts) made under the Regulated Health Professions Act, 1991 and Regulation 543 (X-Ray Safety Code) under the Healing Arts Radiation Protection Act, 1990 and is also proposing a regulation revoking O. Reg. 226/03 made under Medical Radiation and Imaging Technology Act (MRITA). These changes will align the regulations with the Medical Radiation and Imaging Technology Act (MRITA) once it is proclaimed.

Amend the Highway Traffic Act Regulation 615, Signs, to Include New Signs for Traffic Control Purposes

The government is proposing a regulatory amendment to Highway Traffic Act, O. Reg. 615, Signs to improve traffic control and enforceability. The proposed amendments address a request by municipalities to include two new signs in regulation to assist in traffic control and enforcement efforts.

Establishing Efficient Pharmacy Reimbursement Policies

The Ministry of Health and Long-Term Care is proposing amendments to the regulation under the Ontario Drug Benefit Act that, if approved, would change pharmacy reimbursement rules related to drug markup and professional services provided to residents of Long-Term Care Homes to establish a smarter, more efficient and fiscally responsible system to deliver publicly-funded health benefits.

Proposed Amendment to Ontario Regulation 552 under the Health Insurance Act

The Ministry of Health and Long-Term Care is proposing an amendment to Regulation 552 of the Health Insurance Act to end the Out-of-Country Travellers Program. In addition, amendments are being proposed to remove all references to osteopathy that are found under the regulation because osteopathy has not been recognized as a regulated health profession since 2004.

Proposed Amendment to Ontario Regulation 533: Gas Card Modernization

The Ministry of Finance invites your comments on proposed amendments to Regulation 533. Based on input that the Province received during an engagement process in fall 2016, the government is proposing to simplify the process for First Nation individuals and bands to purchase tax-exempt gasoline on-reserve.

Exceptions to Disclosure of Personal Information for Planning and Managing Services under Part X (Personal Information) of the Child, Youth & Family Services Act, 2017 (CYFSA)

Part X establishes authorities for the Minister to collect, use and disclose personal information (PI) for specific purposes including system planning, management and research. Part X allows sharing of PI for these purposes with prescribed entities (PEs) and non-prescribed entities/persons (Non-PEs) (i.e. First Nations, Inuit or Métis entities/persons) in regulation. The proposed regulation names specific PI that is not authorized for disclosure to PEs or Non-PEs (e.g. counselling records).

Prescribing Requirements/Restrictions the Prescribed Body Must Comply with in Conducting Reviews Related to Determinations of Incapacity and Substitute Decision-Making under Part X (Personal Information) of the Child, Youth & Family Services Act, 2017 (CYFSA)

Under Part X, consent for the collection, use and disclosure of personal information (PI) is based on capacity. The Consent and Capacity Board (CCB) is the proposed body to conduct reviews related to determinations of incapacity and substitute decision-making. The proposed regulation sets out the requirements and restrictions for the CCB's procedures in conducting reviews. The procedures will refer to existing procedures CCB operates under in the Health Care Consent Act (HCCA) sections 73-79.

Disclosure for Planning and Managing Services - Requirements for Non-Prescribed Entities or Persons on the Use, Security, Disclosure, Return or Disposal of Information under Part X (Personal Information) of the Child, Youth & Family Services Act, 2017 (CYFSA)

Part X of the CYFSA establishes authorities for the Minister to collect, use and disclose personal information (PI) for specific purposes (e.g. planning and research). The Act also establishes authorities for service providers to disclose PI to non-prescribed entities or persons (Non-PEs) subject to certain requirements and restrictions for the purpose of planning and managing services. The proposed regulation further outlines requirements and restrictions related to these authorities.

Prescribed Reporting to the Information and Privacy Commissioner under Part X (Personal Information) of the Child, Youth & Family Services Act, 2017 (CYFSA)

Part X of the CYFSA establishes rights for children, youth and families to have an oversight body (i.e. the Ontario Information and Privacy Commissioner (IPC)) to turn to if their personal information (PI) has been improperly shared or if requests to access or correct their PI held by service providers have been denied. The proposed regulation specifies what information service providers must provide to the IPC.

Prescribing a Body for Purposes of Capacity and Substitute Decision-Making Reviews under Part X (Personal Information) of the Child, Youth & Family Services Act, 2017 (CYFSA)

Under Part X of the CYFSA, consent for the collection, use and disclosure of personal information (PI) is based on capacity of an individual. The proposed regulation will name the Consent and Capacity Board (CCB) as the body prescribed to conduct reviews related to determinations of incapacity and substitute decision-making under Part X. The CCB is an independent provincial tribunal, whose mission is the fair and accessible adjudication of consent and capacity issues.

The proposed regulation outlines the requirements and obligations for service providers to follow to ensure that research is conducted ethically, privacy is protected, conflicts of interests are avoided, and community interests are represented.

Record Retention, Transfer and Disposal Requirements under Part X (Personal Information) of the Child, Youth & Family Services Act, 2017 (CYFSA)

Under Part X of the CYFSA, service providers are required to take steps to protect records of personal information (PI) that are in their custody or control by retaining, transferring and disposing of them of in a secure manner. The proposed regulation outlines record retention and disposal requirements that will reflect the needs of a diverse child and youth sector and its records while providing general key minimum standards for secure recordkeeping.

Low Carbon Transportation Fuels in Ontario: Amendments to Ethanol in Gasoline (O. Reg. 535/05) and Greener Diesel - Renewable Fuel Content Requirements for Petroleum Diesel Fuel (O. Reg. 97/14) Regulations  (source: Environmental Registry)

The Ministry is proposing to amend the Ethanol in Gasoline and Greener Diesel regulations to create an incentive for emerging renewable fuel technologies, require gasoline suppliers to maintain an average of at least 10% ethanol in regular grade gasoline (88 octane or less), by volume per calendar year and require ethanol used for compliance to emit significantly fewer (e.g. 35%) greenhouse gas (GHG) emissions on a lifecycle basis than petroleum gasoline starting in 2020.

Proposal for a Fish Food Safety Regulation under the Food Safety and Quality Act, 2001

The Ontario Ministry of Agriculture, Food and Rural Affairs (OMAFRA) proposes to replace, subject to the approval of the Legislature, Ontario's Fish Inspection Act and Ontario Regulation 456 - Quality Control with a new regulation under the Food Safety and Quality Act, 2001. The proposed changes would enhance food safety and result in a modern, outcome-based regulation to support the growth and competitiveness of the province's non-federally registered fish processors.
