An out of service declaration prohibits a driver from operating a commercial motor vehicle for a designated period. When implemented, the driver will have a legal obligation to comply with the declaration. A commercial motor vehicle operator (i.e., a carrier) will have a legal obligation to ensure that a driver, operating under the operator's authority, complies with the out of service declaration.
