Proposed amendments to the Employment Standards Act, 2000 for requirement for policies on Electronic Monitoring.

The Ministry of Labour, Training and Skills Development (MLTSD) is consulting on proposed amendments to the Employment Standards Act, 2000 (ESA) that, if passed, would provide greater transparency for Ontario employees regarding electronic monitoring practices by requiring employers with 25 or more employees to have a policy about the electronic monitoring of their employees.

Expanding Reservist leave under the Employment Standards Act, 2000 (ESA)

The Ministry of Labour, Training and Skills Development is proposing to amend the ESA to broaden the reason for taking Reservist Leave to include military skills training and reduce the length of service requirement for Reservist Leave from six to three months.

Proposed amendments to the Employment Standards Act, 2000 for an exemption for certain highly skilled workers.

The Ministry of Labour, Training and Skills Development (MLTSD) is consulting on proposed amendments to the Employment Standards Act, 2000 that, if passed, would provide greater certainty for business and greater flexibility for affected workers by exempting certain "business consultants" and "information technology consultants" from the ESA.

Proposed new legislation, Digital Platform Workers' Rights Act, 2022

The Ministry of Labour, Training and Skills Development (MLTSD) is consulting on proposed new legislation, called the Digital Platform Workers' Rights Act, 2022. If passed, the new legislation would provide certain rights and protections for digital platform workers who provide ride-share, delivery, or courier services.

Proposed Amendments to the Occupational Health and Safety Act - Part IX Offences and Penalties

Various amendments are proposed to the penalties provisions under the Occupational Health and Safety Act (OHSA) to address this. These include: - Increasing the maximum fine from $100,000 to $1,500,000 for directors or officers of corporations and to $500,000 for all other individuals. - Adding a list of aggravating factors that the court must consider for the purposes of determining a penalty under the Act. - Adding a new authority under the Act permitting the courts to impose an order as set in regulation, on convicting a defendant, in addition to any fine or imprisonment imposed. - Extending the limitation period for instituting a prosecution from one year to two years.

Proposed amendments to the Occupational Health and Safety Act to require naloxone kits in workplaces

The Ministry of Labour, Training and Skills Development (MLTSD) is consulting on proposed amendments to the Occupational Health and Safety Act that, if passed, would require an employer who becomes aware, or ought reasonably to be aware, that there may be a risk of a worker having an opioid overdose at a workplace to provide a naloxone kit in that workplace.

Proposal to Enable a New Voluntary Enhanced Time-of-Use Rate Including Consideration of a New Ultra-Low Overnight Price  (source: Environmental Registry)

The government is seeking input on creating an optional enhanced time-of-use electricity rate to encourage consumers to shift electricity use to low-demand periods, modelled after the OEB pricing pilot which included an ultra-low overnight price. We are also seeking input on ways to address barriers to further enable electric vehicle (EV) adoption.

Amendment to 612/20 Centralized Supply Chain Ontario

The Ministry of Government and Consumer Services is seeking approval to amend Ontario Regulation 612/20 "Centralized Supply Chain Ontario" under the Supply Chain Management Act (Government, Broader Public Sector and Health Sector Entities), 2019 (SCMA) to allow Supply Ontario to engage in vendors for the purpose of carrying out its objects and duties, which would include procurement information.

Inclusion of Aboriginal consultation costs as an eligible expense for the retention of proceeds from the sale of samples taken for the purpose of testing on unpatented mining claims

We are proposing to amend O. Reg 45/11 to include consultation-related costs in the list of eligible expenses for the retention of proceeds from the testing of mineral content on unpatented mining claims.

College of Denturists (CDO), College of Massage Therapists (CMTO) and College of Opticians (COO) Professional Misconduct Regulations

The CDO, CMTO and COO are proposing to amend their professional misconduct regulations to clarify and add activities, actions, and behaviours that are considered by the Colleges to be acts of professional misconduct as a result of changes in the practice environment (e.g., new scopes of practice, technology, models of care), to ensure the Colleges are able to hold members accountable for their behaviour and conduct.

Mortgage Brokerages, Lenders and Administrators Act, 2006 (MBLAA) - Proposed New Classes of Licensing

The Ministry of Finance (MOF) is proposing changes to the classes of licensing under the Mortgage Brokerages, Lenders and Administrators Act, 2006 (MBLAA). This posting lays out a proposal to split the existing scope of practice for the present agent licence into two tiered licences, Mortgage Agent Level 1 (MAL 1) and Mortgage Agent Level 2 (MAL 2).

Proposed Interim Changes to the 2012 Building Code to exempt sheds from Building Code requirements

An amendment is proposed to provide more flexibility for property owners who want to store their equipment and other belongings in sheds that are slightly larger than 10 m2, a key Building Code minimum threshold to determine when a structure is considered a building.

Regulatory Proposals under the Fair Access to Regulated Professions and Compulsory Trades Act, 2006 (FARPACTA)

The purpose of FARPACTA is to help ensure regulated professions and individuals applying for registration by regulated professions are governed by practices that are transparent, objective, impartial and fair. On December 2, 2021 amendments were made that provide authority to make regulations concerning registration practices. Under this authority, the MLTSD is considering four proposals.

Protecting Seniors in Retirement Homes: Proposed Regulatory Amendments to O. Reg. 166/11 (General) under the Retirement Homes Act, 2010

The Ministry for Seniors and Accessibility (MSAA) is proposing amendments to Ontario Regulation 166/11 (General) under the Retirement Homes Act, 2010 (RHA). The proposed changes would directly impact the approximately 60,000 Ontarians currenting living in retirement homes as well as those potentially considering a retirement home in the future. A summary of these changes was previously posted for comment (see link to posting 21-MSAA002). At this time, we are posting the draft proposed regulations (full text) for comment.
