Summary of Decision:
Effective July 1, 2012, the government made two regulation changes:

1) Amendments to Ontario Regulation 389/91 (Special Occasion Permits) under the Liquor Licence Act (LLA):
The "auctions" class of special occasion under the LLA was eliminated. Unlike other events which involve the sale, service and consumption of liquor at the event, auctions are a form of retailing.

The Regulation was also amended to clarify that special occasion permits may be issued for private events for the intention of gain or profit, as long as the gain or profit is not from the sale of liquor.

2) Amendments to Ontario Regulation 141/01 (Assignment of Powers and Duties - Liquor Control Act, Regulation 717 of the Revised Regulations of Ontario, 1990) under the Alcohol and Gaming Regulation and Public Protection Act, 1996:

Because auctions are a form of retailing, they will be allowed under the authority of the Liquor Control Act (LCA), rather than the LLA. The power to authorize auction events was assigned to the Registrar of Alcohol and Gaming, the AGCO official who is also responsible for issuing licences and permits under the LLA. The criteria to conduct an auction event did not change. Auctions are required to be conducted by a charity registered under the Income Tax Act (Canada), or by an administrator or executor of an estate or a law enforcement officer acting in the scope of his or her duties.
