Summary of Decision:
On December 9, 2015, a new Noise Regulation (O. Reg. 381/15) under the Occupational Health and Safety Act (OHSA) was approved.
This regulation replaces the noise protection requirements set out in the regulations for Industrial Establishments, Mines and Mining Plants and Oil and Gas-Offshore and extends the same noise protection requirements to all workplaces under OHSA. Examples of workplaces affected by this regulation include construction projects, health care facilities, schools, farming operations, fire services, police services and amusement parks. O. Reg. 381/15 comes into effect on July 1, 2016. This regulation will help protect Ontario's workers from noise-induced hearing loss, a leading cause of occupational disease for Ontario workers.

Summary of Proposal:
The Ministry of Labour is proposing to extend noise protection requirements to all Ontario workplaces under the Occupational Health and Safety Act (OHSA) that are not currently covered by noise requirements in the regulations for Industrial Establishments (Section 139 of Regulation 851), Mines and Mining Plants (Section 293.1 of Regulation 854) and Oil and Gas-Offshore (Section 41 of Regulation 855). Examples of workplaces affected by this proposal include: health care facilities, schools, farming operations, fire services, police services and amusement parks. The proposal builds on the ministry's concurrent proposal to introduce noise protection requirements for Ontario construction workers (please see the MOL's consultation document entitled "Consultation on Improving Occupational Health Protections for Ontario Construction Workers").
The ministry has developed a consultation proposal for public review. The purpose of the consultation proposal is to describe the ministry's proposed policy direction and invite comments from the public and stakeholders.
