College Introduction

In Ontario, the regulation of health professions is based on a self-governance model. There are 25 health regulatory colleges governing 27 health professions under the Regulated Health Professions Act, 1991 (RHPA) and their respective health profession Acts. Health regulatory colleges operate at arm's length from the provincial government and independently administer their own internal processes.

Under the RHPA and the Dental Hygienist Act, 1991, the College of Dental Hygienists of Ontario ("College") is responsible for governing the profession of dental hygienists in Ontario. Under these Acts, the College has the authority to make regulations on a variety of subject matters, including a spousal exemption regulation. All College regulations are subject to the prior review by the Minister of Health and Long-Term Care and the approval of the Lieutenant Governor in Council.

Summary of Proposal

The Ontario Legislature passed legislation that allows each health regulatory college to determine for their respective professions whether it would be permissible to have a patient who is also the member's spouse and to make a regulation permitting a member to have his or her spouse as a patient ("spousal patient").

The proposed regulation would permit a dental hygienist to have his/her spouse as a patient by providing for a "spousal patient" exception to the definition of "sexual abuse" under the Health Professions Procedural Code (Code), which is a Schedule to the Regulated Health Professions Act, 1991 (RHPA).
