Summary of Proposal:
The Making Healthier Choices Act, 2015 received Royal Assent on May 28, 2015. Schedule 1, Healthy Menu Choices Act, requires food service premises with 20 or more locations in Ontario who are selling prepared ready-to-eat food to post calories on menus. The provisions in the Act will come into force on January 1, 2017.
The Ministry of Health and Long-Term Care has developed draft regulations to support the implementation of the menu labelling legislation. The draft regulations were informed by consultations that the Ministry undertook with key partners in the summer of 2015.
The areas of the regulation include:
a) Calorie posting:
- Where calories are displayed
- Definition of "menu"
- How calories are displayed (size, format and prominence)
- How calories are displayed for alcohol
- How calories are determined
b) Standard food item:
- Specify requirements for "standard food items"
c) Contextual statement:
- Content of statement (e.g. "The average adult requires 2,000-2,400 calories a day")
- Format of contextual statement (size, format, placement and prominence)
d) Possible Exemptions:
- Food service premise exemptions
- Standard food item exemptions
