Summary of Proposal:
The Ontario Processing Vegetable Growers (OPVG) is regulated under the Farm Products Marketing Act. OPVG receives its authorities through Regulation 440 (Vegetables for Processing - Marketing), which sets out the board's authority to license producers and green shippers, and to negotiate minimum prices, contract terms, and conditions annually for 14 regulated vegetables for processing.

Regulation 440 establishes the process for negotiations, the establishment of negotiating agencies, appointment of individuals to agencies, and timelines for reporting information to the Ontario Farm Products Marketing Commission (Commission) regarding the negotiating agencies.

Currently, the regulation allows for up to 10 individuals to be appointed by each the OPVG and the Ontario Fruit and Vegetable Processors Association (OFVPA) to each negotiation agency.

In the fall of 2015, the Commission met with vegetable processors and learned that processors would prefer to negotiate with their own active growers of the vegetable that is the subject of the negotiation.

The Commission is proposing to amend Regulation 440, to specify minimum requirements for active growers of each processor to be participants of the negotiating agency for each vegetable.

In addition, the Commission proposes to amend the timing for the communication of negotiating agency appointees by the OPVG and the OFVPA to the Commission to ensure the information is shared with the Commission prior to the commencement of negotiations for each vegetable.

The Commission intends to have the proposed amendments finalized by mid-2016, for implementation by industry when negotiating agreements for the 2017 vegetables for processing crop.
