Summary of Decision:
Regulatory amendments were filed August 2, 2016.
The approved regulatory amendments include:
• Prohibiting child care licensees from charging refundable or non-refundable wait list fees or deposits;
• Requiring licensees to develop a wait list policy that must be included in the parent handbook and which must include a clear explanation of how the licensee determines the order in which children on a wait list are offered admission;
• Requiring that wait list status be made available to those on the wait list, on demand, in a manner that ensures confidentiality.
The ban on wait list fees is effective September 1, 2016, while the amendments related to having a transparent wait list policy and accompanying policies and requirement to updates to parent handbooks will be effective January 1, 2017.

Summary of Proposal:
The consultation document included as part of this posting to the Regulatory Registry Website describes the proposal to use authority under the CCEYA to amend Ontario Regulation 137/15: General to include provisions that prohibit child care licensees from charging wait list fees or deposits and requires licensees to develop a wait list policy.
All interested parties are encouraged to provide feedback on the proposed regulations by July 4, 2016. The ministry values the unique and diverse perspectives from parents/families and broader child care, education, service system management, and early years partners.
