Summary of Proposal:
MAG has amended Regulation 194 (Rules of Civil Procedure) and associated forms.

The amendments will:

1. Facilitate the timely release of a will on deposit with the court by permitting court staff to release the will to a lawyer for an estate trustee (subrule 74.02(7.1, 7.2, 7.3));

2. Clarify the process to obtain the release of a will on deposit with the court where there are multiple estate trustees (subrule 74.02(7)(7.3); and

3. Clarify that legal counsel acting on behalf of a client can complete Form 74.45.1.
