O. Reg. 594/17 (Small Business Programs - subsection 108 (2) of the Act) under the Municipal Act, 2001 was made to implement the proposal.

Ontario Regulation 594/17 comes into force on the later of day subsection 8 (2) of Schedule 1 to the Modernizing Ontario's Municipal Legislation Act, 2017 comes into force and the day this Regulation is filed.

Summary of Proposal:
Municipalities, through municipal small business programs (often referred to as small business incubators), may provide for the establishment of counselling services and provide certain financial incentives to small businesses operating or proposing to operate in the municipality. These programs may be used by municipalities to support the development of small business incubator hubs.

The Modernizing Ontario's Municipal Legislation Act, 2017 received Royal Assent on May 30, 2017. Upon proclamation, legislative amendments to section 108 of the Municipal Act, 2001 would remove the current requirement that municipalities obtain approval from the Minister of Municipal Affairs before establishing small business incubators and replace that provision with a regulation making power.

Accordingly, the Ministry of Municipal Affairs is proposing a new regulation outlining rules for municipalities proposing to put in place municipal small business programs under section 108 of the Municipal Act, 2001, as amended.

Proposed requirements would include:
-Consulting with the public on proposals for such incubators; and
-Adopting and publishing a business case study.

A consultation draft is attached.
