Summary of Proposal:
The Ministry of Community and Social Services is proposing to retain the policy framework contained in the existing CFSA and O. Reg. 464/07. The new proposed regulation achieves this with some updating language so that it works with the language in the CYFSA.
The Ministry is proposing two policy changes to the existing framework regarding adoption disclosure. These are described in the next section below. No other policy changes are being proposed.
Policy Intent of Regulation
Summary Information:
The new regulation does not include the option of a providing a summary of the information available under the adoption disclosure regulation. Presently, O. Reg. 464/07 allows for a summary of the information contained in an adoption file to be provided instead of the copies of records containing information if it is "not practicable" to provide redacted copies of the original documents. This authority is provided in subsection 12 (5) 2 of O. Reg. 464/07 and applies to both a Children's Aid Society and the MCSS custodian.
By eliminating the option of providing summaries of information contained in an adoption file, the Ministry anticipates that persons entitled to information will receive more and better information to which they are entitled to under the adoption disclosure framework.
Timelines for Fulfilling Requests:
The new regulation proposes establishing a timeline, or service standard, for the provision of non-identifying adoption information. The proposed standard would be 30 days with a possible extension up to 90 days. No service standard exists in the current regulation.
This proposal improves client service by providing transparent service times and consistency across the province regarding access to adoption information.
