Summary of Proposal:
Adoption: The regulation proposes to prescribe processes to be followed to register an adoption placement with the Director and procedures that apply with respect to a hearing by the Child and Family Services Review Board following a Director's decision regarding a proposed adoption placement.
Provisions in Regulation 70 made under the Child and Family Services Act (CFSA) that prescribe the method of registering an adoption placement and set out procedures that apply to hearings by the Child and Family Services Review Board respecting a Director's decision regarding a proposed adoption placement, are proposed to be remade in a regulation under the CYFSA. Changes are proposed to these regulatory provisions to align with provisions in the CYFSA respecting a Director's authority to assess a person's eligibility and suitability to adopt and to review a proposed adoption placement when a licensee proposes to bring a child into Ontario to be placed for adoption.
Adoption Licensing: The proposed regulation would prescribe processes to be followed to apply for and maintain a licence to place children for adoption. The proposed regulation would also prescribe obligations of adoption licensees and procedures respecting a hearing to be held by the Licence Appeal Tribunal.
The proposed regulation to be made under Part VIII of CYFSA with respect to adoption would contain provisions that are similar, with only minor changes, from provisions in Regulation 70 that currently apply to adoption licensing.
The proposed regulation would describe the requirements for licensees to obtain and renew their licences, including requirements to establish and maintain trust accounts, files/records pertaining to the adoption placements and prescribe the process of delivery of files/records to the Minister at time of the licensee's closure of operations.
The draft regulations may be posted as an attachment on the regulatory registry at a later date.
