Summary of Decision:
The regulation amendments allow Ontario Health to assume the current responsibilities under PHIPA of Cancer Care Ontario in its capacities as a prescribed entity and a prescribed registry, and to assume the current responsibilities of eHealth Ontario for creating and maintaining the provincial electronic health record. In addition, a regulation amendment extends the revocation date of the regulation provisions enabling operation of the provincial electronic health record from January 1, 2020 to January 1, 2021.
Analysis of Regulatory Impact:
The proposed amendments have no impacts on administrative costs to business and no resource or financial implications within the government, as the proposed amendments would allow Ontario Health to assume the current responsibilities of Cancer Care Ontario (CCO) in its capacities as a prescribed entity and a prescribed registry, and to assume the current responsibilities of eHealth Ontario (eHO) for creating and maintaining the provincial electronic health record. CCO is a planning and research organization that advises the Ontario government on all aspects of provincial cancer care, provides information to health care providers and decision-makers, and motivates better cancer system performance. CCO also facilitates and improves the provision of health care with respect to colorectal, cervical, and breast cancer in its capacity as a prescribed registry. eHO operates the provincial electronic health record which supports the delivery of integrated health care.

Summary of Proposal:
The proposed regulation amendments would allow Ontario Health to assume the current responsibilities under PHIPA of Cancer Care Ontario (CCO) in its capacities as a prescribed entity and a prescribed registry, and to assume the current responsibilities of eHealth Ontario (eHO) for creating and maintaining the provincial electronic health record. In addition, a regulation amendment is also proposed to extend the revocation date of the regulation provisions enabling operation of the provincial electronic health record from January 1, 2020 to January 1, 2021. This extension is necessary to ensure eHealth Ontario or Ontario Health, as the case may be, may continue to create and maintain the provincial electronic health record while the government of Ontario continues the work necessary before Part V.1 of PHIPA could be proclaimed into force. Ontario Health will be required to have its practices and procedures for its prescribed entity and prescribed registry functions reviewed and approved by the Information and Privacy Commissioner of Ontario.
