Summary of Decision:
O. Reg. 445/10 was amended to revoke provisions relating to the operations of Health Quality Ontario, which will no longer be necessary as of its transition into the new Ontario Health agency on December 2, 2019. The regulation was approved on November 4, 2019, filed with the Registrar of Regulations on November 13, 2019 and came into effect on December 2, 2019.
Analysis of Regulatory Impact:
There is no impact to business. The regulation amendment is a minor and technical amendment that is consequential to the passage in April 2019 of The People's Health Care Act, 2019 and to the Government's announced plan to consolidate existing provincial health agencies into Ontario Health.

Summary of Proposal:
O. Reg. 445/10 was amended to revoke provisions relating to the operations of Health Quality Ontario (HQO), which will no longer be necessary after its transition into the new Ontario Health agency. This includes the revocation of provisions restricting HQO's authority to collect, use or disclose personal health information (PHI) as consequential to the repeal of section 13.0.1 of ECFAA in The People's Health Care Act, 2019. The repeal and revocation of the legislative and regulation provisions regarding HQO's PHI restrictions is necessary to enable Ontario Health to carry out the PHI-related functions that it will assume from other legacy agencies (e.g. eHealth Ontario's responsibility for the creation of a provincial electronic data record and Cancer Care Ontario's responsibility of managing the cancer screening registry).
