Summary of Decision:
O. Reg 473/20 and O. Reg. 472/20 amends O. Reg. 354/02 and O. Reg. 353/02 under the Planning Act to empower the Township of Nipissing in relation to two areas of land use planning authority; consent granting authority and plan of subdivision approval.

The exemption provides the Township of Nipissing with the ability to approve development applications without an additional provincial layer of approval. The result will be a streamlined, local decision-making process for development applications in the Township of Nipissing.

Summary of Proposal:
The Ministry of Municipal Affairs and Housing (MMAH) is proposing to amend regulations under the Planning Act to empower the Township of Nipissing in relation to two areas of land use planning authority:

1) Consent Granting Authority

The Minister of Municipal Affairs and Housing is proposing to amend Ontario Regulation 354/02 (Consent Granting Authority) under the Planning Act in order to make the Township of Nipissing the approval authority under sections 53 of the Act. This amendment would give council of the Township of Nipissing the power to approve consent applications within their geography.

It is proposed that the regulation would provide approval authority for consents for the Township of Nipissing on or after July 1, 2020.

2) Approval Authority - Plans of Subdivision

The Minister of Municipal Affairs and Housing is proposing to amend Ontario Regulation 353/02 (Approval Authority - Plans of Subdivision) under the Planning Act in order to make the Township of Nipissing the approval authority under sections 51 and 51.1 of the Act. This amendment would give the council of the Township of Nipissing the power to approve subdivision and condominium applications within their geography.

The regulation would provide approval authority for plans of subdivision/condominium for the Township of Nipissing made on or after July 1, 2020.

Purpose of Regulations:
The Province is committed to a sound, efficient and effective planning system that enhances local autonomy and streamlines decision-making on planning applications.

The proposed regulations provide council with the planning authority to approve consent applications and plan of subdivision/condominium applications within the municipality.

Other Information:
This initiative reinforces MMAH's commitment to ensure that decisions are made at the local level by municipalities that have up-to-date official plans consistent with the Provincial Policy Statement (PPS) 2014.
