These regulations allow vehicle manufacturers, distributors, heavy truck and commercial vehicle dealers to continue to be eligible for the Highway Traffic Act (HTA) privileges restricted to registered OMVIC dealers. These privileges include exemptions from obtaining Used Vehicle Information Packages (UVIP), conducting Drive Clean emissions tests and providing Safety Standards Certificates (SSC) when transferring used vehicles; obtaining dealer plates; and paying reduced fees for vehicle permits. The amendments allow these newly exempt dealers to continue processing vehicle transactions as before.

Summary of Proposal:
The Ontario Motor Vehicle Industry Council (OMVIC) administers the Motor Vehicle Dealers Act, 2002 on behalf of Ministry of Consumer Services (MCS). OMVIC issues dealer numbers to people who are classified as a motor vehicle dealer. The dealer number provides an exemption for a Used Vehicle Information Package (UVIP), conducting Drive Clean emissions test, providing a Safety Standards Certificate (SSC) when transferring used vehicles and allows dealers to remit taxes separately to Ministry of Revenue.
The Act was amended recently and now exempts certain classes of dealers (e.g., vehicle manufacturers, heavy truck dealers, bus and commercial vehicle dealers), from the requirements of the MVDA, 2002. In other words, MCS and OMVIC do not issue dealer numbers to them and they now must comply with vehicle transfer requirements as if they were private citizens.
These amendments will allow industry to perform vehicle transfers in the same manner and receive the same exemptions prior to the amendment of the MVDA.
