Protecting the Health and Safety of Users of the Ontario Food Terminal During the COVID-19 Pandemic.

Summary of Decision:
These two new regulations will provide for the enforcement of health and safety protocols at the Ontario Food Terminal (Terminal) during the COVID-19 emergency.

O. Reg 269/20 requires the Terminal General Manager to develop a protocol to prevent the spread of COVID 19 at the Terminal and to protect against the threat of COVID 19 impacting the ability to operate the Terminal.

O. Reg 275/20 requires all persons at the Terminal to comply with any protocols developed under O. Reg 269/20.

The regulations were filed with the Registrar of Regulations and came into force upon filing.

UPDATE: September 21, 2020:
O. Reg. 269/20: Manager's Protocol Respecting the Coronavirus (COVID-19) has been amended to extend the effective date of the COVID-19 protocol made under this regulation to help to safeguard health and safety, and to remove the requirement for any person entering the Ontario Food Terminal to be actively assessed by Terminal staff for symptoms. Terminal staff are working with public health officials to develop and implement self-screening for tenants and buyers prior to entering the facility. This amendment to regulation will extend the duration of the protocol for one year until September 23, 2021 aligns with evolving best practices and guidance from Ministry of Health related to self-assessment for COVID-19. These amendments help to ensure that Ontario's food supply chain remains strong during the recovery period.

Updated: September 21, 2021: O. Reg. 269/20 has been amended to extend the effective date of the COVID-19 protocol until December 31, 2021. The extension will help continue to safeguard the health and safety of Food Terminal users. The protocol continues to align with evolving best practices and guidance from Ministry of Health.

O. Reg. 269/20 has been amended to extend the effective date of the COVID-19 protocol until April 30, 2022. The extension will help continue to safeguard the health and safety of Food Terminal users.


Analysis of Regulatory Impact:
Given the state of emergency and the immediate need for this regulation in response to the ongoing COVID-19 pandemic, no regulatory impact assessment was conducted. The implementation of this emergency regulation is a further step taken to protect the health and safety of the vital frontline workers who help to feed and nourish Ontarians.
