Electronic Logging Devices (ELD) for Intra-provincial Carriers

Summary of Decision:
An Electronic Logging Device (ELD) is computer-based software that monitors the activities of a commercial driver to ensure compliance with Hours of Service legislation. ELDs are an important safety advancement and will replace the outdated paper log system. Current regulations require drivers of commercial motor vehicles to self-report their on-duty, off-duty and driving time in a paper-based daily log. The information from these logs can be falsified, incomplete, or missing to avoid accountability for non-compliance with regulations.
Transport Canada (TC) amended the federal HoS regulations to mandate the use of ELDs for all federally-regulated commercial truck and bus operators. This new requirement came into force on June 12, 2021, with an education and awareness period without penalty until June 12, 2022.
On June 12, 2022, updates to the provincial Highway Traffic Act Regulation 555/06 (Hours of Service) will come into force. These changes will make it mandatory for commercial motor vehicle drivers who operate within Ontario to use ELDs to record their HoS, replacing the old paper-based daily logbooks. Drivers of commercial motor vehicles who are currently required to maintain a daily log will be required to use a certified ELD.
To simplify operating requirements for Ontario commercial truck and bus carriers that operate both inside and outside of the province, Ontario's ELD mandate closely matches the federal ELD mandate and will take effect for commercial truck carriers on June 12, 2022. This date aligns with the rollout of ELD enforcement for federally-regulated commercial truck and bus carriers. Bus carriers who operate in Ontario only will be required to use a certified ELD as of July 1, 2023.
