Summary of Proposal:
EDU directly operates seven English-language provincial and demonstration schools across four sites (Milton, Belleville, London and Brantford). The schools offer the Ontario curriculum at the elementary and secondary levels as well as specialized integrated programming and student residences. The fifth provincial and demonstration school site is Centre Jules Léger (CJL) which provides the French-language equivalent and is located in Ottawa. It is governed by six elected trustees of the French-language school boards and is known as the Centre Jules-Léger Consortium (CJLC). Provincial and demonstration schools provide individualized education to students who are Deaf, hard of hearing, blind, low vision, Deafblind and students with severe learning disabilities.

Currently Ontario Regulation 296 under the Education Act, requires the Minister of Indigenous Services Canada to make a request, where the student is a First Nation person who ordinarily resides on reserve, to attend a provincial school or the French-language demonstration school operated by CJLC. It does not apply to demonstration schools operated by EDU.

Analysis of Regulatory Impact:
The proposed amendment would allow other persons, such as bands and education authorities established by bands, to also submit requests, in respect of First Nation persons who ordinarily reside on reserve, to attend a provincial school or a demonstration school operated by the CJLC. This is expected to reduce administrative burden for First Nations/bands, parents/guardians, education authorities established by bands, as they would no longer need to seek the federal Minister's approval where a First Nations person who ordinarily resides on reserve seeks to attend one of the provincial schools or a demonstration school operated by CJLC.

This proposed amendment would reflect the fact that bands, or education authorities established by bands, are typically responsible for making decisions respecting the education of First Nation students who ordinarily reside on reserve.
