Summary of Proposal:
The Ministry of Economic Development Job Creation and Trade (MEDJCT), Office of Small Business and Red Tape Reduction (SBRTR) is proposing a regulatory amendment to the Modernizing Ontario for People and Businesses Act, 2020 (MOPBA) will remove the exemptions from electronic submission of documents applying to the Ministry of the Environment, Conservation, and Parks (MECP) under requirements within the Environmental Assessment Act, 1990.

The amendment will remove the following exemption:

(e) the document is required to be submitted to the Ministry of the Environment, Conservation, and Parks in order to comply with,

(i) Ontario Regulation 116/01 (Electricity Projects) made under the Environmental Assessment Act,

(ii) Ontario Regulation 101/07 (Waste Management Projects) made under the Environmental Assessment Act, or

(iii) Ontario Regulation 231/08 (Transit Projects and Metrolinx Undertakings) made under the Environmental Assessment Act.

The regulatory amendment is designed to support the burden reduction and regulatory modernization work currently being undertaken across Ontario and to align with the ongoing work to modernize the Environmental Assessment program, including in relation to electronic submissions.

Costs
The regulatory amendment is applicable only to MECP and will impose no compliance costs on for-profit businesses, not-for-profit organizations, or the broader public sector.

The regulatory amendment is also not expected to result in any additional costs to government. MECP is responsible for implementing the requirements of electronic submission of documents under section 5 of MOPBA from which they were previously exempted. The amendments are not expected to require additional staff time in the affected ministry.

MEDJCT-SBRTR will be responsible for training and tracking the ministry's compliance with the requirements. This work will be managed within existing budget allocations.

There are no new administrative costs for regulated entities.

Benefits
The regulatory amendment is designed to further reduce regulatory burden in Ontario by making the regulatory process more effective, transparent, and accountable by requiring electronic submission of documents under MOPBA via the removal of exemptions to MECP.
