The Ministry of Labour, Training and Skills Development (MLTSD) is proposing amendments to the Occupational Health and Safety Act (OHSA) to require the owner of a workplace to provide access to a washroom to delivery workers, i.e., persons making deliveries to or from the workplace.

Summary of Proposal:
The Ministry of Labour, Training and Skills Development (MLTSD) is proposing amendments to the Occupational Health and Safety Act (OHSA) to require the owner of a workplace to provide access to a washroom to delivery workers, i.e., persons making deliveries to or from the workplace. Exemptions are provided for health and safety reasons and reasons related to the circumstances of the workplace. Private residences would also be excluded from the new requirement.

The proposal will improve health and safety rights for delivery workers while providing important exemptions for owners who legitimately cannot provide these workers with access to a washroom.
Analysis of Regulatory Impact:
It is not anticipated that the proposal will impose new costs related to compliance on businesses. The proposal only requires business owners to provide delivery workers with access to their existing washrooms within their facilities. Business owners will not be required, under the proposed new requirements, to create new washroom facilities or alter their existing washroom facilities.
