Summary of Decision:
Bill 126 repealed sections 159 and 159.1 of the Highway Traffic Act and replaced them with one section. The amendments to Ontario Regulation 339/94 (Demerit Point System) revised the Demerit Point Table to reflect the new section 159 of the Act and now applies demerit points upon conviction for the offences included in the previous section 159 of the Act, i.e., failing to stop upon the approach of a police department vehicle, an ambulance, a fire department vehicle or a public utility emergency vehicle and following a fire department vehicle too closely. The Demerit Point Table has also been amended to include offences related to the failure to secure a child passenger as set out in section 106 of the Act.

Summary of Proposal:
Bill 126, the Road Safety Act, 2009, received Royal Assent on April 23, 2009. Bill 126 repealed sections 159 and 159.1 of the Highway Traffic Act and replaced them with one section. The amendments to Ontario Regulation 339/94 (Demerit Point System) will revise the Demerit Point Table to reflect the new section 159 of the Act and apply demerit points upon conviction for the offences currently included in section 159 of the Act, i.e., failing to stop upon the approach of a police department vehicle, an ambulance, a fire department vehicle or a public utility emergency vehicle and following a fire department vehicle too closely.

The Demerit Point Table will also be amended to include offences related to failure to secure a child passenger as set out in section 106 of the Act. These legislative offences were not included in an earlier amendment to the Table for child car seat offences set out in Regulation 613 of the Act.
