Administrative Penalties Regime for Ontario One Call

Summary of Proposal:
The Getting Ontario Connected Act, 2022 received Royal Assent on April 14, 2022. Among other things, the Act amends the Ontario Underground Infrastructure Notification System Act, 2012 (One Call Act) to address immediate pressure points in the locate delivery system, enhance governance and oversight of Ontario One Call, and improve Ontario One Call's compliance tools.

The legislative changes provide Ontario One Call with authority to issue administrative penalties against non-compliant members and excavators in the industry for specified contraventions. A new regulation outlining the details of the administrative penalty regime was developed in order to implement this regime. The ability to issue administrative penalties will strengthen Ontario One Call's enforcement and compliance framework by providing an additional tool for it to use to promote compliance with the One Call Act.

The Ministry made changes to the draft Minister's regulation to account for stakeholder feedback received from consultations held via the Ontario Regulatory Registry and through industry roundtables. The Minister approved and signed the regulation on January 30, 2023. The regulation will take effect on April 1, 2023.

Important details like penalty amounts and the use of funds are captured in the regulation. The regulation is required in order to implement the administrative penalty regime, which will be administered by Ontario One Call.

There are no costs to government and no new administrative or compliance costs for business.
