Summary of Proposal:
The ministry is considering potential amendments under the Condo Act to expand the jurisdiction of the CAT allowing online dispute resolution for disputes related to owners' meetings.
Part I.2 of the Condo Act and related regulations, including O. Reg. 179/17, set out provisions related to the CAT's jurisdiction.
The proposed expansion may include disputes related to the following topics regarding owners' meetings:
• Requisitioning a meeting
• Meeting timelines and procedures
• Meeting notices
• Quorum
• Voting
To support this proposed expansion of the CAT's jurisdiction, the ministry is exploring bringing into force certain sections of the Protecting Condominium Owners Act, 2015 (PCOA) that would amend sections in the Condo Act regarding owner requisitioned meetings and non-leased voting units. The ministry is also exploring the development of regulations under the Condo Act that would support the proclamation of these PCOA provisions.
The ministry is looking for feedback on these potential changes. Members of the public can provide feedback through the survey link provided in the attachment section below. Feedback should be provided via the link by July 11, 2024.
Analysis of Regulatory Impact:
The ministry is not currently proposing any specific regulatory changes at this time. However, the ministry will undertake necessary analysis to identify associated regulatory impacts should specific regulatory changes be proposed.
