Delegation of Appointment of Police Officers under the Community Safety and Policing Act, 2019

Regulation Number(s):
N/A
Instrument Type:
Regulation - LGIC
Bill or Act:
Community Safety and Policing Act, 2019
Summary of Proposal:
The Community Safety and Policing Act, 2019 (CSPA), came into effect on April 1, 2024, replacing the Police Services Act (PSA). The CSPA modernizes policing and enhances community safety in Ontario.

At this time, SOLGEN is requesting public and stakeholder input on a proposed regulation under the CSPA that would enable a police service board to delegate the power of appointing police officers to the chief of police or to a non-police service board employee.

The ministry is also considering prescribing, as an additional duty for police service boards under clause 37 (1) (k) of the CSPA, a duty to publish the names of persons appointed as police officers if the appointment is delegated to the chief of police or to an employee of the board who is not a member of the police service.

For more detail, please see the attached description of the regulation.

SOLGEN welcomes your comments and feedback.
Analysis of Regulatory Impact:
SOLGEN may be consulting with stakeholders to identify whether there are any potential costs associated with the given regulation coming into force.
