Summary of Proposal:
Conducted energy weapons (CEWs) have been approved for use in Ontario since 2002.

Ontario Regulation 391/23: Use of Force and Weapons, prescribes models of CEWs that may be used by members of police services and special constables employed by the Niagara Parks Commission.

Currently, the TASER X26P, TASER X2 and TASER 7 models are prescribed.

Ontario is proposing to prescribe the TASER 10, manufactured by AXON Enterprises Inc., on the basis of medical and effectiveness testing, user and instructor survey results, and other available inputs.

The TASER 10 differs from previous models and includes features that were designed to improve accuracy and effectiveness in a wider variety of scenarios including:
• the ability to immediately deploy up to 10 probes, compared with to 4 probes, which provides more opportunities to achieve an intended result before having to reload the weapon;
• a longer deployment range of up to 45 feet, compared to only 25 feet in previous models, to allow use of the weapon at a greater distance from the subject and to create additional time and space for decision making and potential de-escalation; and
• individually targeted probes enabling the user to create their own probe spread (to achieve neuromuscular incapacitation), compared to the previous need to deploy two probes simultaneously at a predefined angle.

Ontario Regulation 391/23 continues to require minister-prescribed training be completed before a CEW may be carried or used, and establishes restrictions on the use of CEWs.

Analysis of Regulatory Impact:
Adoption of the TASER 10 by police services or the Niagara Parks Police Service would be a local decision. As a result, there are no direct costs associated with this regulatory amendment.
