Summary of Proposal:
The Ministry of Red Tape Reduction (MRTR) is proposing amendments to the Modernizing Ontario for People and Businesses Act, 2020 (MOPBA) that include new requirements for ministries to analyze and report on the potential regulatory and administrative impact of proposed Government of Ontario instruments affecting individuals.
MRTR is proposing the following changes to MOPBA:
• Updating the Act's preamble to reflect the government's continued commitment to reducing burdens and improving services for individuals.
• Amending the principles of regulatory modernization to include individuals and requiring Government of Ontario ministries to reflect on these principles when developing proposals where applicable.
• Requiring Government of Ontario ministries to complete an analysis of regulatory impact and publish that analysis when an instrument governed by MOPBA is being proposed that would affect an individual where applicable.
• Providing regulation making authority to the Lieutenant Governor in Council (LGIC) respecting, among other things, criteria for when an analysis of regulatory impact on individuals is required and the manner of its publication.
Some of the proposed changes are intended to come into effect at a later date after supporting regulatory amendments are created. Additional details about how the requirements will be applied will be determined during regulation development.
