Summary of Proposal:
The Minister of Municipal Affairs and Housing has the authority under section 218.3 of the Municipal Act, 2001 to appoint the heads of council for the Regional Municipalities of Niagara, Peel and York during the 2022-2026 term of council.

Section 218.5(1)(b) allows the Minister to make regulations providing for modifications to the Municipal Act, 2001 that are necessary for the implementation of the Minister's authority to appoint these heads of council.

Under the Municipal Act, 2001, in order to hold office on an upper-tier council a person must meet the requirements to be a municipal voter in a constituent lower-tier municipality including: they must reside in the municipality or be the owner or tenant or spouse of an owner or tenant of land in the municipality; be a Canadian citizen; and be at least 18 years old.

A new Minister's regulation would modify the Municipal Act, 2001 so that a person appointed by the Minister under the section 218.3 authority would not be required to reside in a constituent lower-tier municipality or be the owner, tenant or spouse of an owner or tenant of land in the municipality in order to be eligible for appointment.
