Summary of Proposal:
If passed, this new statute, titled the Restricting Public Consumption of Illegal Substances Act, 2024, would prohibit the use of illegal substances in public spaces, with limited exemptions and allow police officers and other provincial offences officers, if prescribed, to direct individuals to stop using illegal drugs or to leave the public space. If an individual does not comply, officers will be able to issue a ticket and/or arrest individuals.

There will likely be some indirect costs for impacted stakeholders (e.g., time to learn about new prohibition, exemptions, authorities and penalties) associated with the proposed Restricting Public Consumption of Illegal Substances Act, 2024.
