College Introduction

Under the Regulated Health Professions Act, 1991 (RHPA) and the Kinesiology Act, 2007, the transitional Council of the College of Kinesiologists of Ontario (transitional Council) is, among other things, responsible for making regulations respecting the future self-regulating profession of kinesiology in Ontario.

Under these Acts, the transitional Council may make regulations on a variety of subject matters, including professional misconduct, subject to the prior review of the Minister of Health and Long-Term Care and the approval of the Lieutenant Governor in Council.

A major function of the College will be to investigate complaints and concerns about members and to discipline members who engage in serious misconduct. The purpose of the professional misconduct regulation is to define for members of the College and the public the types of activities and behaviours that are unacceptable.

Summary of Regulation

Professional misconduct, in the health regulatory context, is conduct that is unethical, improper or dishonest if committed by a member of a College.

The purpose of the regulation is to define conduct that is unethical, improper or dishonest. This ensures that members of the heath profession and the public understand what acts, if committed and proven, could amount to a finding that a regulated health professional committed an act of professional misconduct.
