Summary of Proposal:
MTO is proposing two amendments to Regulation 512/97 (Critical Defects of Commercial Motor Vehicles) related to inoperative brakes and air brakes.

Inoperative Brakes

MTO is proposing to include inoperative brakes as one of the critical defects for the purposes of the commercial vehicle impoundment program. This proposed change will ensure that the most dangerous and unsafe vehicles are removed from the highway.

Air Brakes

Lastly, MTO is proposing an amendment to ensure that the testing procedures for air brake equipped vehicles in this regulation are consistent with those in Regulation 587 (Equipment). An amendment to Regulation 512/97 is required to clarify that an initial air pressure between 90 and 100 pounds per square inch (psi) is required when taking measurements of brakes.
