Summary of Decision:
Part VII of the Mining Act and O. Reg. 240/00 provide Ontario's framework for the rehabilitation of mining lands, including the requirement for advanced exploration and mine production closure plans and associated financial assurance.
Amending the regulation to include a reference to advanced exploration better reflects the graduated approach to advanced exploration and mine production closure planning.
The new name of the regulation is Advanced Exploration, Mine Development and Closure Under Part VII of the Act.

Analysis of Regulatory Impact:
This change to the name of the regulation has no regulatory impact and no relationship to compliance costs. The Ministry considers the proposed name to be more descriptive. There are no costs to businesses.

Part VII of the Mining Act and O. Reg. 240/00 provide Ontario's framework for the rehabilitation of mining lands, including the requirement for advanced exploration and mine production closure plans and associated financial assurance.

The proposal to amend the name of O. Reg. 240/00 to include a reference to advanced exploration closure plans to better reflect the graduated approach to advanced exploration and mine production closure planning.

Stakeholders expressed concerns that closure plan regulations do not address different scales of operations and that this causes confusion and burden for the mining industry. This name change would support ongoing work to develop guidance documents and to pursue further regulatory amendments that strengthen a graduated approach to closure planning.
