Equipment and Use of Force Regulatory Amendments and Implementation of a Modernized Use of Force Report

Summary of Decision:
Amendments to Ontario Regulation 960 of R.R.O. 1990, made under the Police Services Act, came into effect on January 1, 2023. These amendments to the Equipment and Use of Force Regulation established new reporting requirements and the adoption of a Modernized Use of Force Report by all police services in Ontario.
Analysis of Regulatory Impact:
The Regulatory Impact Analysis shows there would be an initial cost for training and development borne by police services in order to come into compliance with these changes. The new upfront direct compliance costs are estimated to total between $9,027.98 - $11,284.99 for all municipal police services. Dedicated training time is necessary for members to learn about the regulation and the new reporting requirements to successfully/accurately complete the Modernized Use of Force Report (form).

Summary of Proposal:
The Ministry of the Solicitor General (SolGen) is requesting public and stakeholder input on amendments to police use of force reporting requirements in the Equipment and Use of Force Regulation as well as on a modernized Use of Force Report (report).
The proposed amendments to the regulation and the report seek to clarify and enhance existing reporting requirements and improve data collection by police services and the ministry.

The proposed amendments to the Equipment and Use of Force Regulation will:
• clarify areas that have been subject to differing interpretation;
• bring reporting requirements in line with current best practices;
• establish requirements for reporting by supervisors and teams; and,
• facilitate analyses of the data and public reporting.

Additionally, in partnership with stakeholders, the ministry has been working on modernizing the Use of Force Report to:
• ensure it is reflective of current practices;
• include more significant information pertaining to the subject and the full range of officer responses/force options;
• facilitate analyses to inform training and policy on both in-service and provincial levels;
• address deficiencies in the current data to enable the ministry's analysis and public reporting on race and use of force to assist in identifying and addressing systemic racism pursuant to the Anti-Racism Act, 2017 (ARA); and,
• enable collection of additional contextual information for more effective and informative annual use of force reporting by police services, including analyses of use of force trends.
