Ontario Regulation 3/12 (Council Composition - Regional Municipality of Durham):

Ontario Regulation 3/12 authorizes Durham Regional Council to initiate the prescribed local process to change the method of selecting the Regional Chair.

The prescribed process is found in section 218 and 219 of the Municipal Act, 2001. These sections provide that the head of an upper-tier council can be elected by general vote or appointed by the members of council. In order to make a change to the composition of an upper-tier council, the Minister must pass a regulation to allow the municipality to begin the process to make the change.

Following the passing of the regulation, the Municipal Act, 2001, requires that the upper-tier council give notice of its intention, hold at least one public meeting and pass a by-law to change the composition of regional council. Once the by-law is passed, it must be circulated to lower-tier municipalities within the region for endorsement. The by-law must receive triple majority support to be valid.

Ontario Regulation 3/12 came into force on January 8, 2012.
