O. Reg. 187/12 delegates the authority of the Minister of Municipal Affairs and Housing under:
-Subsections50(18) of the Planning Act to approve a foreclosure or exercise of power of sale;
-Section 53 of the Planning Act to give consents; and,
-Section 57 of the Planning Act to issue certificates of validation to the council of the

Township of McGarry with respect to all applications for land in that municipality made on or after this Regulation comes into force.

In January 2012, the Ministry of Municipal Affairs and Housing received a Council resolution requesting delegation of Ministerial approval for consents and related approvals.

The majority of municipalities in Timiskaming District have been delegated Ministerial approval for consents and related approvals.

The Official Plan for the Township of McGarry was approved May 25, 2011 and is consistent with the Provincial Policy Statement. The Township subsequently passed their first zoning by-law. These local planning documents provide direction on the full range of provincial and local land use planning interests, and serve as guidance for local decision-making.

The Township is located in northeast Timiskaming District between the Province of Quebec and the Township of Larder Lake. It has a year round population of 674. The Township was formed in 1946.

The Planning Act enables the Minister, by order, to delegate Ministerial approval of consents and related approvals, thus allowing a local authority to approve these applications in lieu of the Minister.
