College Introduction
In Ontario, the regulation of health professions is based on a self-governance model. There are 23 health regulatory colleges governing 25 health professions under the Regulated Health Professions Act, 1991 (RHPA) and their respective health profession Acts. Health regulatory colleges operate at arm's length from the provincial government and independently administer their own internal processes.
Under the RHPA and the Pharmacy Act, 1991, the Ontario College of Pharmacists (OCP) is responsible for governing the profession of pharmacy in Ontario. Through the provisions contained within these Acts, the OCP has the authority to make regulations on a variety of subject matters, including professional misconduct, subject to prior review by the Minister of Health and Long-Term care and the approval of the Lieutenant Governor in Council.
Summary
The OCP made specific changes to its professional misconduct regulation to address issues related to:
- a new class of registrants;
- the expanded scope of practice; and
- the expectation that members will exercise professional judgment in choosing to deliver services and/or referring patients to another health professional as needed.
These amendments provide the OCP with additional tools to govern its members in the public interest by among other things, taking into account current college policies and guidelines and the Model Standards of Practice for Canadian Pharmacists.
