Addition to eligibility requirements of the Industrial Conservation Initiative (ICI)

Summary of Decision:
The Ontario government is committed to providing competitive electricity rates for energy intensive consumers while simultaneously promoting the conservation of energy, including electricity.

The Government is moving forward with a new initiative, for the purposes of electricity rate mitigation planning, and in the context of changing supply conditions in the electricity system, to increase our ability to gather and share data related to the Industrial Conservation Initiative (ICI).

The amendment to O.Reg. 429/04 adds an eligibility requirement for involvement in ICI. Each ICI proponent will provide written consent to the Independent Electricity System Operator (IESO) or their Local Distribution Company, to share the following information with the Ministry of Energy with an understanding that the information may be used publicly:

• ICI consumer's company name,
• The address and geographic location of the ICI consumer's head office,
• The address and geographic location of the consumer's load facilities participating in the ICI.

This regulatory amendment is in effect as of April 24, 2015.

In 2010 the government introduced the ICI as a set of amendments to Ontario Regulation 429/04.

The ICI charges the largest consumers in the province who can meet a specific average monthly peak demand threshold (either 3 Megawatts or 5 Megawatts, depending on the industry classification), termed Class A consumers, a global adjustment rate proportional to their share of peak demand measured during the five highest-peak hours in the year.

Continuing our commitment to economic competitiveness, the ICI was expanded to a wider range of eligible energy intensive electricity consumers through regulatory amendments to Ontario Regulation 429/04 effective from May 1, 2014.

Summary of Proposal:

The Government now intends, for the purposes of electricity rate mitigation planning, and in the context of changing supply conditions in the electricity system, to increase our ability to gather and share data related to the Industrial Conservation Initiative (ICI).

This will be achieved by amending Ontario Regulation 429/04 to add an eligibility requirement for involvement in ICI. Each ICI proponent will provide written consent to the Independent Electricity System Operator (IESO) or their Local Distribution Company, to share the following information with the Ministry of Energy with an understanding that the information may be used publicly:

• ICI consumer's company name,
• The address and geographic location of the ICI consumer's head office,
• The address and geographic location of the consumer's load facilities participating in the ICI.

This regulatory amendment is proposed to take effect on the date it is filed with the Registrar of Ontario.
