Summary of Proposal:
Bill 17, the Protecting Child Performers Act, 2015, received Royal Assent on May 5, 2015. The purpose of this new legislation is to promote the best interests, protection and well-being of child performers in the live entertainment industry and the recorded entertainment industry. The Act will come into force on February 5, 2016.
The Ministry of Labour is proposing to develop a regulation that would support the Act's provisions relating to income protection, tutoring, travel expenses, and criminal records. Specifically, the regulation could
• prescribe a parent or guardian's maximum daily expenses, travel costs and accommodation costs payable under subsection 6 (4) of the Act;
• govern tutoring for child performers during a production or project;
• prescribe persons who are authorized to hold money in trust for child performers under subsection 8 (1) of the Act;
• prescribe rules in connection with the establishment of trusts for the purposes of section 8 of the Act;
• govern the time and manner in which money shall be remitted for the purposes of section 8 of the Act;
• govern the administration of money held in trust for child performers under section 8 of the Act;
• define "clean criminal record" for the purposes of clause 21 (2) (d) and section 22 of the Act;
• prescribe individuals who would be required to have a clean criminal record for the purposes of section 22 of the Act;
• define any word or expression that is used in this Act but not defined in this Act;
• provide for transitional matters which, in the opinion of the Lieutenant Governor in Council, are necessary or desirable to facilitate the implementation of this Act; and
• address any matter necessary or advisable to carry out effectively the intent and purpose of the Act.
The Ministry of Labour is seeking input on these above subjects.
