College Introduction
In Ontario, the regulation of health professions is based on a self-governance model. There are 26 health regulatory colleges governing 28 health professions under the Regulated Health Professions Act, 1991 (RHPA) and their respective health profession Acts. Health regulatory colleges operate at arm's length from the provincial government and independently administer their own internal processes.
Under the RHPA and the Massage Therapy Act, 1991, the College of Massage Therapists of Ontario ("College") is responsible for governing the profession of massage therapists in Ontario. Under these Acts, the College has the authority to make regulations on a variety of subject matters. All College regulations are subject to the prior review by the Minister of Health and Long-Term Care and the approval of the Lieutenant Governor in Council.
Summary of Proposal
The proposed regulation amendments would increase accessibility to funding for therapy and counselling for clients who have been sexually abused by College members and include the following:
• Provision to expand the definition of member to encompass former members who are no longer registered with the College (examples: retired, suspended or had their registration revoked);
• Confirmation that the Client Relations Committee has the authority to determine funding for the program;
• Provision that a person's eligibility for funding for therapy does not constitute a finding against a College member;
• Provision to expand the eligibility requirements of funding for therapy for persons who were sexually abused while they were clients of members; and,
• Allows the College, at its discretion, to extend funding for therapy to clients who were sexually abused prior to December 31, 1993, before the RPHA came into force.
