Summary of Decision:
O.Reg. 117/10, which amends Regulation 717 (General) made under the Liquor Control Act was filed on March 29, 2010.

Section 2.2 of Regulation 717, which requires the LCBO to set, and government stores to abide by, minimum prices for beer, is revoked effective April 12, 2010, when sections 8 and 9 of O.Reg. 116/10 (Minimum Pricing of Liquor and Other Pricing Matters) made under the Act comes into force.

Section 2.3 of Regulation 717, which sets out a process for beer manufacturers to change the price of their products, has been revoked. It has been replaced by sections 11 and 12 of O.Reg. 116/10 (Minimum Pricing of Liquor and Other Pricing Matters), which came into force on March 29, 2010. Subsection 11(3) of that regulation addresses beer prices changes on July 1, 2010, when the harmonized sales tax is implemented.

These changes consolidate into one regulation the regulatory rules relating to the pricing of liquor in government stores.

Subsection 19(3) of Regulation 717 is amended to remove reference to the provincial sales tax and reflect the current application of container deposits to all forms of liquor. This amendment will come into force on July 1, 2010, when the harmonized sales tax is implemented.
