Summary of Proposal:
The policy proposal guiding the drafting of the regulation is as follows:

To be listed in a regulation under subsection 68(1), a "First Nations, Inuit or Métis community" should be understood to be a distinct First Nations, Inuit or Métis peoples with shared identity, history and governance.

To be listed in a regulation under the Act, the representative structure of a First Nations, Inuit or Métis community must request that it be listed as a First Nations, Inuit or Métis community for the purposes of the Act.

The First Nations, Inuit or Métis community's representative structure is considered to be a government and/or body that was established by the community as its political representative. Such a government and/or other representative body has the authority to represent its people. Individual members of a community or a service provider that serves members of the community would not be considered a representative structure of a community.

A First Nations, Inuit or Métis community is considered to be a distinct First Nations, Inuit or Métis political community. A community that seeks to become listed must identify whether it is a community of First Nations, Inuit or Métis peoples.
