Summary of Decision:
Ontario Regulation 252/10, which amends Regulation 369 (R.R.O 1990) under the Farm Implements Act, takes effect July 1, 2010 and will apply to the sale and safety of farm implements in Ontario.

The amended regulation removes references to unnecessary requirements for registrations (i.e. providing the Director with a description of service facilities and staff, copies of service agreements and warranty policies), which will minimize the paperwork dealers and distributors have to do to register their companies.

The safety of all farm implements sold by dealers remains a priority, and replacement safety decals are still required for used farm implements. However, the regulation no longer specifies which decals must be used,. The changes also update references to the ministry and to safety standards for farm equipment.

Summary of Proposal:
The Farm Implements Act regulates the sale and safety of farm implements in Ontario. The Act contains requirements for the registration of dealers and distributors and requirements for specific safety labels for new and used farm implements. The proposed amendments to Regulation 369 would remove references to unnecessary requirements for registrations, (i.e. providing the Director with a description of service facilities and staff, copies of service agreements and warranty policies), which will minimize the paperwork dealers and distributors have to do to register their companies. The safety of all farm implements sold by dealers remains a priority, and replacement safety decals are still required for used farm implements. However, the proposed amendments would no longer specify which decals must be used, further reducing the burden on stakeholders. The proposed amendments would also update references to the ministry and to safety standards for farm equipment.
