Summary of Proposal:
In December 2019, legislation was passed to modernize the legal framework for the sale, service and delivery of beverage alcohol. Ontario's liquor legislation has not been comprehensively updated in over 40 years.

The new legal framework for alcohol includes five new statutes: the Liquor Licence and Control Act, 2019, the Liquor Control Board of Ontario Act, 2019, the Liquor Tax Act, 1996, the Alcohol and Gaming Commission of Ontario Act, 2019, and the Liquor Sales Agreements Act.

The new legal framework will make it easier for businesses and consumers to understand the rules, separate the LCBO's operational function from the AGCO's regulatory function, reduce red tape, and increase flexibility for businesses to reflect the changing landscape of beverage alcohol.

This posting focuses on a proposal related to including a regulation under the Liquor Licence and Control Act, 2019. This change would enable eligible grocery stores and wine boutiques to sell wine and cider through their websites for curbside pickup.

Regulatory requirements would include:
-Click and collect / curbside pickup could be offered 7am - 11pm
-Social responsibility requirements currently in place for the sale of beverage alcohol would apply to click and collect / curbside pickup (e.g., employee training, cannot provide liquor to those under the age of 19 or to intoxicated persons)
-Contiguous aisle requirement must be reflected in the online environment (e.g., a dedicated section of the website for wine and cider)
-Wine and cider must be stored at the eligible grocery store's location that the product is being picked up from, and supplied from the inventory of the eligible grocery store.

This regulation under the new legal framework will improve consumer choice and convenience, and create more opportunity for the private sector to compete in the sale and distribution of beverage alcohol.
