An amendment to Minister's Regulation 380/04 under the Emergency Management and Civil Protection Act to provide criteria for when a ministry or municipality is not required to conduct an annual practice emergency exercise.
Analysis of Regulatory Impact:
This amendment to Minister's Regulation 380/04 under the Emergency Management and Civil Protection Act will reduce red tape by increasing the flexibility for municipalities and ministries to allocate their emergency management resources while still requiring emergency management plans to be tested annually through the annual practice emergency exercise or responding to an emergency.

A regulatory amendment is required because Minister's Regulation 380/04 does not contain provisions that allow for circumstances when the annual practice emergency exercise is not required.

Summary of Proposal:
An amendment to Minister's Regulation 380/04 under the Emergency Management and Civil Protection Act has been made effective December 22, 2022 to specify that municipalities and ministries are not required to conduct the annual practice emergency exercise in a year where:

For municipalities:
o The Municipal Emergency Control Group (MECG) directed the municipality's response in an emergency during that year, and the emergency lasted for at least 48 hours;
o The MECG implemented the municipality's emergency response plan and the MECG's procedures to respond to an emergency during that year; and
o The MECG complies with any other requirements that may be specified.

For ministries:
o The Ministry Action Group (MAG) directed the ministry's response in an emergency during that year, and the emergency lasted for at least 48 hours;
o The MAG implemented the ministry's emergency plan and the MAG's procedures to respond to an emergency during that year; and
o The MAG complies with any other requirements that may be specified.
