Requirements for Menstrual Products at Construction Projects

Summary of Decision:
Amendments to O. Reg. 213/91 (Construction Projects) under the Occupational Health and Safety Act (OHSA) have been approved to require that menstrual products be provided at projects expected to last three months or more and at which twenty or more workers are regularly employed.
The menstrual products have to include both tampons and menstrual pads and be kept clean and hygienic. The menstrual products would have to be provided in one or more locations such that for each worker there is at least one location that offers a reasonable amount of privacy and that is reasonably accessible.
These amendments are intended to encourage inclusivity in the industry and support women in the skilled trades in the construction sector.
The amendments come into effect on January 1, 2025.
Analysis of Regulatory Impact:
All ministries are subject to requirements set out in the Modernizing Ontario for People and Businesses Act, 2020 (MOPBA), which came into force January 1, 2021. As part of its obligations under the MOPBA, the Ministry of Labour, Immigration, Training and Skills Development conducted a Regulatory Impact Analysis (RIA) of these amendments. A RIA is a process of identifying and assessing the incremental benefits and costs of regulations and non-regulatory alternatives.
It is anticipated that there would be some implementation costs and administrative burdens associated with these amendments. However, these are difficult to predict generally and are dependent on frequency of use, and the size of the construction site.
