Summary of Decision:
Ontario Regulation 137/15 was amended to permit camps to operate during a strike by or lockout of school board employees when in-person instruction is not being provided. This amendment provides greater flexibility for camps to operate during periods of remote instruction and provides additional options for parents who need supervision for their children if schools are closed to in-person instruction.

Typically, when proposing new regulations under the CCEYA, the Ministry of Education is required to post a description of the proposed regulation on Ontario's Regulatory Registry and allow for public comment on the proposal for at least 45 days.

However, subsection 84(6) of the CCEYA gives the Minister of Education authority to determine that no public consultation will be undertaken in certain circumstances. Given the urgency of the situation, the Minister determined that no public or stakeholder consultations would be conducted in this instance.

The amended regulations took effect on the day they were filed.
Analysis of Regulatory Impact:
The amendment supports choice for parents and places no additional regulatory burden on businesses in Ontario; the amended regulation supports the businesses that operate camps by allowing them to operate on instructional days during a labour disruption.
